Rental Terms and Conditions

Welcome to BVcar!

Our goal is to provide a simple, honest and hassle-free car rental service.

These Rental Terms and Conditions have been prepared to ensure that both you and we have a clear understanding of how the rental works and what the rights and responsibilities of both parties are. We have tried to avoid complicated legal language and make these terms as simple and easy to understand as possible.

We believe that a good car rental experience is based on trust, clear communication and transparent terms. Our aim is therefore not to create an unnecessarily long agreement, but to provide you with all the important information in one place.

If you have any questions before or during your rental period, please feel free to contact us. We are always happy to help and can usually find a solution quickly through friendly communication.

Thank you for choosing BVcar. We wish you a safe and enjoyable journey in Tenerife!

1. General Provisions

These General Terms and Conditions govern the vehicle rental agreement between Best Vacation Group S.L. (BVcar) and the renter.

By confirming a booking or signing the Rental Agreement, the renter confirms that they have read and understood these Terms and Conditions and agree to comply with them.

If the individual Rental Agreement contains terms that differ from these General Terms and Conditions, the terms of the individual Rental Agreement shall prevail.

BVcar aims to provide a simple, honest and transparent car rental service. The purpose of these Terms and Conditions is to clearly explain the rights and responsibilities of both parties and to prevent misunderstandings.

2. Driver Requirements

Under our standard rental conditions, a vehicle may be rented by a person who meets at least one of the following requirements:

  • is at least 25 years old; or
  • has held a valid driving licence for at least two years.

At the time of vehicle handover, the driver must present:

  • a valid driving licence;
  • a valid passport or identity card.

If the driving licence was issued in a country whose licence is not independently valid in Spain, the driver must also present an International Driving Permit or another document required in Spain.

Only drivers listed in the Rental Agreement are permitted to drive the vehicle.

One additional driver is included free of charge.

If a driver does not meet the standard requirements, they may contact BVcar for a personalised offer. In such cases, BVcar will assess each request individually and determine whether the vehicle can be rented and under what conditions.

BVcar reserves the right to refuse to hand over the vehicle if the driver’s documents are incomplete or if the driver’s condition does not allow them to drive safely.

3. Booking and Payment

Bookings can be made up to 24 hours before the requested rental period begins. If you need a car at shorter notice, please contact us directly — if possible, we will be happy to find a suitable solution for you.

Before confirming a booking, the customer can review and correct the booking details entered in the booking form.

By submitting the booking, the customer confirms that the booking details are correct and that they have read and accepted these Rental Terms and Conditions.

A booking is considered confirmed once BVcar or BVcar’s booking system has sent the customer a booking confirmation by email.

If the booking is made through a third-party booking platform, the terms and conditions of that platform may also apply to payment, booking changes and cancellations in addition to these Rental Terms and Conditions.

Unless otherwise agreed, the rental amount is payable when the vehicle is handed over.

The rental amount may be paid in cash, by bank card or by bank transfer. If the customer wishes to pay by bank transfer, the payment must have been received in BVcar’s bank account before the vehicle is handed over.

If the renter has given explicit consent in the Rental Agreement, BVcar may use the payment card details provided to collect justified outstanding amounts arising from these Rental Terms and Conditions or the Rental Agreement. Before charging the card, BVcar will inform the renter of the reason for and amount of the charge.

The BVcar website, booking system and Rental Terms and Conditions are available in English, Spanish, Estonian and Russian.

The Rental Agreement is concluded in English and Spanish.

4. Booking Changes and Cancellations

Bookings may be changed subject to vehicle availability.

If a change affects the rental period, vehicle category or other important conditions, the rental price may also change.

A booking may be cancelled free of charge up to 24 hours before the agreed vehicle handover time.

If a booking is cancelled less than 24 hours before the start of the rental period, or if the customer fails to collect the vehicle and does not inform BVcar of a delay, BVcar has the right to charge a cancellation fee of up to the cost of two rental days, based on the rates applicable when the booking was made.

If the customer’s flight is delayed or cancelled, please inform BVcar as soon as possible. Whenever possible, we will arrange a new handover time with the customer without unnecessary inconvenience.

5. Rental Price

The rental price includes:

  • all applicable local taxes;
  • full insurance in accordance with these Terms and Conditions;
  • unlimited mileage;
  • one additional driver free of charge;
  • a child safety seat or booster seat free of charge, subject to availability;
  • roadside assistance during the rental period.

The rental price does not include:

  • fuel;
  • parking fees;
  • traffic and parking fines;
  • other chargeable additional services;
  • costs resulting from a breach of the Rental Terms and Conditions.

All additional charges will be disclosed to the customer before the Rental Agreement is concluded.

BVcar does not add hidden service charges during the rental period.

6. Security Deposit

BVcar requires a security deposit when renting a vehicle.

The amount of the deposit depends on the vehicle and is generally either €100 or €300. The exact amount will be shown to the customer before the booking is confirmed.

The security deposit is not an additional fee. It is used only to cover costs or damage for which the renter is responsible under these Rental Terms and Conditions.

Where necessary, BVcar may use the security deposit to cover:

  • the cost of missing fuel and a refuelling service charge;
  • extraordinary cleaning;
  • cleaning required as a result of smoking;
  • lost or damaged keys, documents or additional equipment;
  • traffic and parking fines and any related legally applicable administrative costs;
  • towing, recovery or relocation costs resulting from misuse of the vehicle;
  • damage resulting from a breach of the Rental Terms and Conditions;
  • other outstanding amounts arising from the Rental Agreement.

If the vehicle is returned in the agreed condition and the renter has no outstanding obligations, the security deposit will be returned or released without undue delay using the same payment method by which it was paid.

If BVcar receives a traffic or parking fine or another justified claim relating to the renter’s period of use after the rental period has ended, the renter remains responsible for paying it even if the security deposit has already been returned.

7. Full Insurance

The rental price of all BVcar vehicles includes full insurance.

Provided that the vehicle is used in accordance with the Rental Agreement and these Rental Terms and Conditions, full insurance covers unexpected and accidental damage occurring during the rental period.

Full insurance does not apply only in the circumstances listed in Section 8, “When Full Insurance Does Not Apply”.

Full insurance remains valid throughout the agreed rental period.

If an accident occurs or the vehicle is damaged during the rental period, please contact us as soon as possible. This allows us to assess the situation quickly and, where necessary, arrange roadside assistance or other appropriate assistance.

The scope of full insurance does not reduce the renter’s obligation to comply with these Rental Terms and Conditions.

8. When Full Insurance Does Not Apply

Full insurance does not apply if the damage results from a breach of the Rental Agreement or these Terms and Conditions.

Full insurance does not apply, among other circumstances, in the following cases:

  • the vehicle is driven by a person who is not listed as a driver in the Rental Agreement;
  • the driver is under the influence of alcohol, narcotics or other substances that impair their ability to drive;
  • the vehicle is deliberately used in a negligent or dangerous manner;
  • the vehicle is driven or parked on beaches, off-road, on forest tracks or on other roads or areas unsuitable for passenger vehicles;
  • incorrect fuel is used;
  • the vehicle is used for illegal purposes;
  • the vehicle is used after the end of the rental period without BVcar’s consent;
  • the damage is caused intentionally or through gross negligence.

If full insurance does not apply, the renter is responsible for the resulting damage and related costs.

9. Vehicle Handover and Return

BVcar will hand over the vehicle to the renter clean, technically roadworthy and ready for use.

Before the vehicle is handed over, its condition will be documented by photographs or video.

We also recommend that the renter inspect the vehicle before using it. If the renter notices any damage that has not previously been documented, BVcar must be informed before the renter starts driving.

The vehicle must be returned:

  • on the agreed date and at the agreed time;
  • to the agreed location;
  • together with the keys, documents and additional equipment;
  • in the same general condition, allowing for normal use.

If the vehicle is returned outside business hours or without a BVcar representative being present, the renter must follow the return instructions agreed in advance.

If it has been agreed that the keys will be left inside the vehicle or in a key box, the renter must take photographs or a video showing both the interior and exterior of the vehicle and send them to BVcar.

If the parties have agreed in advance on a contactless vehicle return, the renter must park the vehicle at the agreed location, leave the key in the agreed manner, take clear photographs or a video showing the condition of both the exterior and interior of the vehicle, and send them to BVcar.

The renter’s responsibility for the vehicle ends once all agreed return procedures have been properly completed and the photographs or video have been sent to BVcar. However, the renter remains responsible for any damage, violations or deficiencies that occurred during the rental period or before the vehicle was properly returned, even if they are discovered by BVcar at a later time.

The renter is not responsible for damage occurring after a properly completed contactless return where such damage was not caused by the renter’s actions or omissions.

10. Use of the Vehicle

Please use the vehicle responsibly and comply with all applicable traffic regulations in Spain.

When the vehicle is not in use, the renter must ensure that:

  • the vehicle is locked;
  • the windows are closed;
  • the keys are not left inside the vehicle;
  • the vehicle is parked in a safe and permitted location.

Please ensure that the correct type of fuel is used.

If a warning light appears on the dashboard or a technical problem occurs, the renter should stop driving where reasonably possible and contact BVcar immediately.

The renter is responsible for any additional damage caused by ignoring warning signals.

If the vehicle keys or remote control are lost or damaged during the rental period, the renter is responsible for the cost of replacement or repair.

11. Prohibited Use

The vehicle must not:

  • be driven by a person who is not listed as a driver in the Rental Agreement;
  • be used for racing or speed trials;
  • be used to tow another vehicle or trailer;
  • be used for illegal activities;
  • be driven under the influence of alcohol or narcotic substances;
  • be used deliberately in a dangerous or reckless manner;
  • be driven on beaches, off-road, on agricultural tracks or on other roads or areas unsuitable for passenger vehicles;
  • be repaired or modified without BVcar’s permission;
  • be made available to a third party without BVcar’s written consent.

The vehicle may be taken to other Canary Islands only with BVcar’s prior approval.

Taking the vehicle outside the Canary Islands is not permitted.

12. Fuel Policy

The vehicle is handed over with a specified fuel level.

The renter must return the vehicle with the same fuel level.

If the vehicle is returned with less fuel than at the time of handover, the renter will be charged for the missing fuel and a refuelling service fee.

If the vehicle is returned with more fuel than at the time of handover, no separate reimbursement will be provided.

The renter is responsible for any costs resulting from filling the vehicle with the incorrect type of fuel.

13. Traffic and Parking Fines

The renter is responsible for all violations of traffic and parking regulations committed during the rental period and for any resulting fines, charges and other legally applicable obligations.

If a fine or other claim is sent to BVcar after the rental period has ended and relates to the renter’s period of use, the renter is responsible for reimbursing the corresponding amount.

Where necessary, BVcar may provide the renter’s details to the competent authorities where required for the processing of a fine or another legal claim.

If a fine or other claim is paid from the security deposit, BVcar will inform the renter and provide the basis for the claim and, where possible, supporting documentation.

If the security deposit has already been returned or is insufficient to cover the amount, the renter agrees to pay the outstanding amount after being notified of the claim.

14. Accident, Damage and Roadside Assistance

If an accident occurs, the vehicle is damaged or a technical fault arises during the rental period, the renter should contact BVcar as soon as possible.

Where necessary, the police or emergency services must be contacted, particularly if:

  • anyone has been injured;
  • another vehicle is involved in the accident;
  • the vehicle cannot be safely driven;
  • vandalism or theft is involved.

Where possible, please take photographs of the scene and any damage and collect the contact details of the other parties involved.

Where possible, please do not voluntarily admit liability at the scene or enter into agreements with other parties before consulting BVcar.

If the vehicle cannot be safely used and the reason is not related to a breach of the Rental Terms and Conditions, BVcar will, where reasonably possible, arrange roadside assistance or a replacement vehicle depending on the circumstances and vehicle availability.

The availability of a replacement vehicle depends on the vehicles available at the time.

If the breakdown or damage is caused by a breach of the Rental Terms and Conditions, the renter may be responsible for the related costs.

15. Vehicle Cleanliness, Smoking and Pets

All BVcar vehicles are non-smoking.

Smoking and the use of electronic cigarettes inside the vehicle are prohibited.

If the vehicle requires deep cleaning or odour removal due to smoking, the actual cost of the required cleaning will be charged.

Please return the vehicle in a reasonably clean condition.

Normal dirt resulting from ordinary use will not result in an additional charge.

If the vehicle is returned in a condition requiring cleaning beyond normal cleaning, the actual cost of the additional cleaning may be charged.

Pets may only be transported with BVcar’s prior approval.

When transporting pets, the renter is responsible for returning the vehicle clean and undamaged. Where necessary, the actual cost of cleaning or repairing damage will be charged.

Legal exceptions applicable to assistance dogs remain unaffected.

16. Child Safety Equipment

BVcar provides child safety seats and booster seats free of charge upon request and subject to availability.

The renter is responsible for selecting suitable safety equipment and ensuring that it is correctly installed.

If the customer is unsure which safety equipment is appropriate, we will be happy to assist.

17. Processing of Personal Data

BVcar processes customers’ personal data only to the extent necessary for:

  • managing bookings;
  • performing the Rental Agreement;
  • processing payments;
  • complying with legal obligations;
  • handling potential damage claims or fines.

BVcar does not sell or disclose customers’ personal data to third parties unless required by law or necessary for the performance of the Rental Agreement.

Customers have the right to access their personal data and request its correction or deletion in accordance with applicable data protection legislation.

18. Liability

BVcar makes every reasonable effort to provide the customer with a technically roadworthy, clean and safe vehicle.

If a technical fault occurs during the rental period and is not caused by the renter’s actions or a breach of the Rental Terms and Conditions, BVcar will make reasonable efforts to resolve the issue as quickly as possible.

To the extent permitted by law, BVcar is not liable for damage or delays caused by circumstances that the company could not reasonably foresee or control. Such circumstances may include, for example, extreme weather conditions, natural disasters, traffic accidents, road closures, disruption to air travel, strikes, restrictions imposed by public authorities or other circumstances of force majeure. In such cases, BVcar will make reasonable efforts to find a suitable solution for the customer.

These Rental Terms and Conditions do not limit any rights granted to the customer under Spanish or European Union law.

19. Governing Law and Dispute Resolution

These Rental Terms and Conditions are governed by Spanish law.

In the event of a disagreement, the parties will first attempt to resolve the matter between themselves in good faith and within a reasonable period of time.

If an agreement cannot be reached, disputes will be resolved by the competent court in accordance with Spanish law.

Final Note

The purpose of these Terms and Conditions is not to restrict the customer’s rights, but to ensure that both parties have clear and understandable rules.

We believe that the best car rental experience is built on trust, honest communication and transparent terms. If you have any questions before or during your rental period, please feel free to contact us. We are always happy to help.
